Terms of Service

1. Acceptance of Terms
By using NaviCast Eco ("Service", "Platform") or registering a vessel for monitoring, you agree to these Terms. If you act on behalf of a company, you confirm you have authority to bind that entity. If you do not agree, do not use the Service.
2. Service Description
NaviCast Eco monitors vessel speeds in real time using public AIS satellite data, compares them against user-defined eco-speed targets, and delivers Telegram alerts to designated contacts when thresholds are exceeded. The platform provides EU ETS cost estimations for informational purposes only.
3. Subscription Plans and Pricing

All prices are exclusive of VAT. VAT is applied as required by EU law based on your billing country. We reserve the right to update pricing with 30 days' notice to existing subscribers.
4. Free Trial
New subscribers are eligible for a 14-day free trial. No credit card is required to start monitoring via the public registration form. At the end of the trial, monitoring stops unless you subscribe to a paid plan. We will send a reminder email 3 days before trial expiry.
5. Telegram Alerts — Acceptable Use
- You must ensure that all Telegram recipients have consented to receive automated alerts from NaviCast Eco before registering their number.
- You may not register numbers belonging to people who have not consented.
- Recipients can opt out at any time by replying STOP to any alert message.
- Alerts are transactional notifications only — we do not send marketing messages via Telegram.
6. Cancellation Policy
- Cancel anytime from your account settings or by emailing youssef.ayadi1752011@gmail.com.
- Cancellation takes effect at the end of the current billing period. You retain access until then.
- We do not provide pro-rated refunds for partial months, except where required by EU consumer law.
- Subscriptions cancelled within 14 days of first payment are eligible for a full refund (EU cooling-off period).
7. Service Uptime
Best effort — Starter and Growth plans
99.5% monthly SLA — Enterprise plans, with service credits if missed
AIS data delivery depends on the availability of aisstream.io and is not within our direct SLA. Scheduled maintenance is announced 48 hours in advance.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of maritime law
- Track vessels without authorisation from the vessel operator
- Attempt to reverse-engineer, decompile, or extract source code
- Resell or white-label the Service without a written agreement
- Conduct denial-of-service attacks or attempt to breach security
- Register phone numbers without consent of the recipient
Violation of this section may result in immediate account termination without refund.
9. Data Ownership
You retain full ownership of all vessel data, IMO/MMSI numbers, and configuration data you enter. We claim no intellectual property rights over your data. AIS positional data is public maritime broadcast data.
10. Limitation of Liability
To the maximum extent permitted by EU law, NaviCast Eco shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profit, revenue, or business opportunities
- EU ETS regulatory penalties or fines arising from non-compliance
- Inaccuracies in AIS data sourced from third-party streams
- Failures in Telegram message delivery caused by Telegram's infrastructure or network conditions
Our total liability for any claim shall not exceed the fees you paid in the 3 months preceding the claim. Nothing here limits liability for death, personal injury caused by negligence, or fraud.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS". WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT AIS DATA IS ACCURATE, COMPLETE, OR CURRENT. THE PLATFORM IS AN ADVISORY TOOL — COMPLIANCE DECISIONS REMAIN THE RESPONSIBILITY OF THE VESSEL OPERATOR.
12. Governing Law
These Terms are governed by EU law and the laws of the EU member state in which NaviCast Eco is registered. Disputes shall first be attempted through good-faith negotiation. If unresolved within 30 days, they go to the competent courts of our domicile, unless you are an EU consumer (in which case you may also use your local courts).
EU consumers may use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13. Changes to Terms
We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance.
